The Seller(s) are serious about selling this property, but reserve the right to accept or reject the winning bid. Each bid shall constitute an offer to purchase, and the winning bid, if accepted by the Seller(s), shall constitute a binding contract between Buyer(s) and Seller(s).

This sale is not contingent upon financing or inspections and is being sold “AS IS ~ WHERE IS”. It is recommended to all bidders to inspect the property prior to placing any bids. Buyers must conduct their own inspections at their own expense prior to bidding.

PROCEDURE: Bidding ends Monday, February 12, 2018 at 11:00 a.m. CST, with a soft close, meaning that a last minute bid will extend bidding by 5 minutes. 

BUYERS PREMIUM: 5% Buyer’s Premium will be added to the final bid price to arrive at the contract sale price. 

ACCEPTANCE OF BID PRICES: Winning bidder(s) will enter into a Contract to Purchase immediately upon being declared the Successful Bidder by United Country Farm & Home Real Estate. Upon the close of the auction the winning bidder will be forwarded via email a Contract to Purchase. United Country Farm & Home Real Estate must receive a signed copy of the contract on or before 11:00 a.m. CST, February 13, 2018 (hand delivered, faxed or scanned and emailed). 

DOWN PAYMENT: 10% of the contract purchase price must be received by Black Creek Abstract & Title, LLC within 48 hours of the auction closing. Acceptable forms of payment include: cashier’s check, personal or corporate check, or wire transfer. The balance of the purchase price will be due in full at closing. 

 

CLOSING/CLOSING AGENT: Closing shall be on Wednesday March 14, 2018 at Black Creek Abstract & Title, LLC. Closing agent shall be Black Creek Abstract & Title, LLC. Buyer to pay Closing Agent Fee. Out of area buyers will be afforded the opportunity to close via email, mail, and wire transfer of certified funds.

POSSESSION: Possession will be given at closing.

MINERAL RIGHTS: All Seller(s) owned mineral rights will convey to Buyer(s) at closing.

TITLE: Seller shall furnish the Buyer(s) at Seller(s) expense an Owner’s Policy of Title Insurance in the amount of the purchase price, and agrees to provide and execute a proper deed conveying merchantable title to the real estate to the Buyer(s). 

SURVEY: Seller will provide an existing survey. 

REAL ESTATE TAXES: Seller(s) shall pay 2017 and all-prior year’s real estate taxes, if any. The Buyer(s) will pay All 2018 real estate taxes.
